Supreme Court says children can lose property if they don’t take care of their parents

The Supreme Court has said that children who receive property from their parents but fail to take care of them can lose that property. This decision is based on a law made in 2007 to protect senior citizens.

In a case from Chhatarpur, Madhya Pradesh, a mother gave her property to her son through a gift deed, but the son did not take care of her. The Court canceled the gift deed and ordered the son to return the property to his mother by February 28.

According to the 2007 law, if a senior citizen gives their property to someone on the condition that they will look after them, and the person doesn’t fulfill this responsibility, the transfer of property can be considered as fraud. In such cases, the court can cancel the property transfer.

This ruling reminds everyone that caring for elderly parents is important, especially when they transfer their property to their children with the expectation of being looked after.
